Enox Duncan, 65, was taken into custody on St. Thomas on Saturday morning, October 10, 2026, and booked on a new misdemeanor criminal complaint. The arrest represents another cycle in a pattern that began three years earlier, when prosecutors in the territory chose to release him despite serious charges stemming from a church incident.
On March 18, 2023, Duncan entered the Church of God Seventh Day at Upper Love on St. Croix. He was wearing a woman's dress and soliciting money from worshippers. When Pastor Michael Jules Sr. asked him to leave, Duncan responded: "I am the pastor, not him!" and struck off-duty Detective Moses President in the face, creating a laceration beneath his right eye.
Fighting broke out on the church grounds as members of the congregation moved to restrain Duncan. Detective President struck Duncan multiple times with a baton, fracturing his left forearm. Duncan was transported to Governor Juan F. Luis Hospital for emergency surgery and subsequently arrested on three serious misdemeanor counts, including aggravated assault on a police officer.
In April 2023, a court-ordered psychological evaluation by Dr. G. Rita Dudley-Grant found Duncan had a Full-Scale IQ of 62, in the "Impaired" range. The evaluation identified delusional disorder, generalized anxiety disorder, and paranoid personality disorder. Despite these findings, Dr. Dudley-Grant determined Duncan was legally competent to stand trial.
With competency established, prosecutors held the legal authority to move forward. Instead, they pursued an informal resolution. At a May 17, 2023 status conference, Assistant Attorney General Esther Walters told the judge that Duncan's sister in Florida was "considering filing a Petition for Guardianship for the Defendant in her home state of Florida." No formal guardianship, interstate arrangement or conservatorship was put in place.
Judge Ernest E. Morris Jr. ordered Duncan released from custody. On May 31, 2023, prosecutors moved to dismiss all charges "with prejudice," surrendering any future right to prosecute him for those offences. The judge approved the dismissal.
Duncan did not relocate to Florida. Court records show he had accumulated 11 prior arrests, predominantly for criminal trespass and disturbing the peace. He had received outpatient mental health treatment in his twenties but stopped taking medication around age 30.
He now faces a new case on St. Thomas and remains in custody pending an advise-of-rights hearing.
