St. Croix refinery settlement clears first hurdle, residents have until November to claim

A $59.8 million settlement for residents harmed by 2021 Limetree Bay refinery accidents has won preliminary court approval.

Residents of St. Croix affected by toxic oil mist released during refinery accidents in 2021 have until November 3 to submit claim forms to participate in class action settlements totalling $59.8 million.

District Court Judge Mark Kearney granted preliminary settlement approval on September 8. A final approval hearing is scheduled for December 14.

The accidents occurred during an attempt to restart the Limetree Bay Refinery. Residents say the toxic substance contaminated their properties and cisterns, and that noxious odors caused health effects including headaches, nausea, and shortness of breath.

Settlement class members can opt out or object until October 27. Those who do not respond and comply with court requirements may waive their right to object and "shall be bound by the terms" of any final orders, according to court documents.

The settlements cover approximately 22,000 class members. If approved as structured, $36.25 million would remain for settlement payments after attorneys' fees and costs of $23.5 million are deducted. The fund could grow if additional settlements are reached with other defendants.

The settling defendants. EIG Global Energy Partners, Limetree Bay Ventures, Limetree Bay Energy, ArcLight Capital Partners, Pinnacle Services, and Universal Plant Services, do not admit liability but agreed to settle to avoid continued litigation costs.

Plaintiffs continue to pursue claims against remaining defendants not included in this settlement.
