A Frederiksted resident faced three criminal charges after allegedly throttling a man until he lost consciousness at Lorraine Village Apartments, but a magistrate has dismissed the most serious count.

Kimberly J. Parker appeared Monday before Magistrate Judge Yolan Brow Ross at the R.H. Amphlett Leader Justice Center in Kingshill. The Department of Justice had pursued third-degree assault, simple assault and battery, and disturbance of the peace.

Judge Brow Ross determined there was sufficient evidence to proceed on simple assault and battery and disturbance of the peace, but ruled the felony third-degree assault charge lacked probable cause, court records show.

The alleged incident

The confrontation took place around October 9 near Building 19 at Lorraine Village Apartments in Frederiksted, according to court documents. Prosecutors contended that Parker repeatedly pressed her hands against the neck of a man named Oswald Joseph, restricting his airway until he became unconscious and sustained injuries.

Additional allegations state Parker lifted Joseph by the neck, threw him to the floor, and struck him multiple times. The victim reportedly experienced intense pain in his throat, chest, and ribs.

Bond and court schedule

Parker was formally arraigned and released on a fully unsecured $25,000 bond, requiring only her signature. Judge Brow Ross mandated that she remain at her registered address and comply with all conditions of her release.

The case now rests with Superior Court Judge Ernest Morris Jr. Parker must return to the Kingshill courthouse on January 13, 2027, at 9:00 a.m. in Courtroom CR-211 for a discovery conference.
